Facts for Survivors Opting NOT to Press ChargesOverviewSurvivors who do not wish to press charges have legal options and rights as well. The rape occurred whether or not there’s a charge filed or a prosecution, and you should still consider how you can take care of yourself and start to heal. Medical Exam A medical exam is important for your physical health. A medical exam can now be done before or instead of the police filing. An exam should include HIV prophylaxis if you feel you may have been exposed to the AIDS virus, emergency contraception, and/or treatment of physical injuries. This exam can be taken at any time after the assault. Forensic Exam A "rape kit" can be done within 72 hours of an assault, but earlier is better. The exam will not be sent to the police unless you choose to do so. Any forensic and medical evidence collected will be very helpful if you decide to press charges. Having the exam is safe and confidential, and leaves you future options. It helps you take care of yourself and it buys you time if you want to wait before filing. Reimbursement You may file a claim to be reimbursed for medical/forensic expenses with the NYS Crime Victims Board, even if you don’t go to the police. Punishment If you want to seek some kind of penalty, you must report to the police, even though you lose some control. |
